[PT2021] Aberdeen Unhappy With Graeme Shinnie's Four-Match Ban

Aberdeen are infuriated at the Scottish FA's decision to hand captain
Graeme Shinnie a four-match suspension following his red card against Ross
County last week. Shinnie was sent off for an aggressive challenge on Jack
Baldwin at Dingwall but after appealing their suspension they received this
extended punishment from them.

PFA Scotland have come out in support of Aberdeen FC and have called out
Graeme Shinnie's four-match ban as "ridiculously harsh and unnecessary".
Additionally, they do not believe the discretionary powers of the
disciplinary panel are appropriate and would like to see rules change as
soon as possible.

Shinnie was sent off during Friday's 1-0 Premiership win against Ross
County when referee Euan Anderson issued him with the red card after VAR
intervention, prompting the Dons to appeal and an independent panel heard
their case on Tuesday.

The club had argued that Shinnie's tackle on County defender Jack Baldwin
was a direct challenge and should have been met with immediate red card
action from Anderson; however, Anderson upheld his decision not to issue
such sanction at that time.

Aberdeen were incensed when Shinnie received a four-match suspension based
on their assessment that his appeal "lacked merit or had no chance of
succeeding". They found this action an abuse of process and delaying
tactic, and called upon Scottish FA to review this ruling using a different
panel.

Dons boss Barry Robson has urged the Scottish FA to review the appeals
panel’s verdict

The club are understandably dissatisfied with Shinnie's four-match ban for
his VAR challenge on Ross County defender Jack Baldwin, which they had
sought a review of following an initial three match ban following a
disciplinary panel hearing. Unfortunately, however, Shinnie appealed
against this and now his red card appeal has been upheld and an additional
game added onto his suspension.

Aberdeen have won four of their six games under Robson since taking over
from Jim Goodwin, moving only four points behind Hearts into third place
and scoring an impressive 3-0 victory against them before the international
break. Robson has successfully established himself as an important force in
their fight for third place and European football qualification.

But is he the right man to lead Aberdeen on its long-term journey? Will he
be able to turn around a squad which has seen 14 first-team players leave
either through loan deals or expiring contracts this summer?
Shinnie’s ban is a slap in the face for the Dons

On Friday evening after being identified during a VAR review for his
involvement in Aberdeen's 1-0 win against Ross County, Shinnie was sent off
after receiving two match bans due to serious foul play and another match
due to SFA ruling that his appeal had no chance of succeeding.

The Dons have taken exception to the Football Association (FA) decision,
calling on its governing body to revaluate their appeals process and refer
the case directly to a new disciplinary panel.

Shinnie has been handed a four-match suspension, which they regard as being
unfair and a blow against his club. Shinnie will miss Sunday's clash
against Rangers as well as three crucial matches against fellow top six
rivals Celtic, Celtic's first three cinch teetering on top six positions
and Pittodrie are struggling in league standings compared with last season.
Additionally, this ban marks only the latest instance where such a penalty
has been issued against one player since it became available years ago.

The appeals process is flawed

Appeal proceedings allow parties who believe that a trial court made an
incorrect ruling to petition a higher court for review of and modification
to their decision.

Appeal processes utilizes all of the evidence presented during trial and
require parties who wish to overturn its verdict to present written
documentation called a brief before an appeals panel of judges, which then
makes their determination on their appeals case.

Common causes for appeals include judge errors in deciding the
admissibility or inadmissibility of evidence, mistakes in collecting such
evidence, or prosecutorial misconduct such as suppressing or failing to
turn over exculpatory material.

At oral argument, appellate counsels must respond directly and respectfully
to judges' inquiries; otherwise they risk becoming defensive and hostile
towards the panel, which could seriously hinder their efforts to convince
them.
