[Law25] North Carolina State Bar: Student Practice Certification (Fall 2024)

Good morning, all,



Please read this email if you will be working at a legal organization during the Fall 2024 semester (including internships, externships, and part-time jobs) and will be required to obtain your Student Practice Certification from the North Carolina State Bar.  (Note: This was formerly known as the “Third-Year Practice Rule” but is no longer limited to 3Ls). If you will be enrolling in a clinic, you can disregard this email and follow your clinical instructor’s process.



You will need the Certification if you wish to engage in the activities listed in 27 N.C.A.C. Chapter 1C, Rule .0206<https://www.ncbar.gov/for-lawyers/governing-rules-of-the-state-bar/0206-activities/>, including representing an eligible person, the State in criminal prosecutions, a criminal defendant who is represented by the public defender, or a government agency in judicial proceedings. Campbell does not certify students; however, the State Bar has asked us to facilitate the process by gathering and submitting students’ applications. To that end, please complete and send the following forms to me (nsanders at campbell.edu<mailto:nsanders at campbell.edu>) with the subject line “Student Practice Certification”:



If you will be working as an INTERN or PART-TIME CLERK:

  1.  Student Certification
  2.  Field Placement Certification
  3.  Memo of Understanding



If you will be working as an EXTERN (i.e., enrolled in an Externship course):

  1.  Student Certification
  2.
Field Placement Certification

Some organizations that host numerous students (such as DA and PDs offices) prefer to complete their own Field Placement Certification and submit it directly to the State Bar so that they can list all of their students at once. That is fine – just let me know that when you send me your remaining form(s).


Once I receive your forms, I will make sure everything is completed correctly and send them to the Registrar’s Office, who will complete the school’s certification and send the packet to the State Bar. The State Bar will then contact you and your Supervising Attorney directly. Do not engage in the activities under Rule .0206 until you have received the Certification from the State Bar.



A couple of final things I want to highlight:

  1.  You must be in good academic standing to obtain the Certification.
  2.
“Eligible persons” (defined in Rule .0202<https://www.ncbar.gov/for-lawyers/governing-rules-of-the-state-bar/0202-definitions/>) does not include a private firm’s regular book of business.
  3.  Your Supervising Attorney must put a precise date range on the Field Placement Certification. The State Bar will not accept ranges such as “Fall Semester 2024” or “August to December 2024.” If you want to later extend it, you generally can.
