[Law25] North Carolina Student Practice Certification

Good morning, all,

Please read this email if you will be completing an internship, externship, or part-time legal job next semester that requires you to obtain your Student Practice Certification from the NC State Bar. (NB: if you will be enrolling in a clinic, follow your clinical professor's instructions.)

What is it? The Student Practice Certification allows students to engage in the activities outlined in Rule .0206<https://www.ncbar.gov/for-lawyers/governing-rules-of-the-state-bar/0206-activities/> of 27 N.C.A.C. Chapter 1C. This includes representation before a federal, state, or local tribunal or an administrative agency. If you have questions about whether you need to be certified, you should ask your supervising attorney first.

Am I eligible? The certification is no longer limited to only 3Ls, and all students in good academic standing may seek it provided they have an eligible opportunity and supervisor. The State Bar's rules governing the certification discuss eligibility and can be found at 27 N.C.A.C. Ch. 1 - Sec. .0200<https://www.ncbar.gov/for-lawyers/governing-rules-of-the-state-bar/0201-purpose/>. Both you and your supervisor will be expected to be familiar with all of these rules.

Because it is a recurring question, I will note that you may only represent "an eligible person, the state in criminal prosecutions, a criminal defendant who is represented by the public defender, or a government agency" in court proceedings. "Eligible persons" is defined in Rule .0202<https://www.ncbar.gov/for-lawyers/governing-rules-of-the-state-bar/0202-definitions/> and does NOT include a law firm's regular book of business.

How do I get certified? Although the State Bar ultimately certifies students, they ask us to help facilitate the process by gathering and submitting necessary forms from students.

If you are completing an externship, please complete and return the following forms to me via email:

If you are completing an internship or part-time legal job, please complete and return the following forms to me via email:

Memorandum of Understanding

Two things to note for the Field Placement Certification:

Your supervisor must put a specific date range (i.e., XX/XX/XXXX - YY/YY/YYYY)
  *
Some organizations that have a lot of students (e.g., a DA or PD's Office) prefer to submit one field placement certification to the Bar themselves so they can list all of their students at once. That is fine—just let me know when you send me your other form(s).

Once I receive these documents, I will send them to the Registrar's Office who will complete the law school's certification and submit your packet to the State Bar. The State Bar will then contact you and your supervisor directly.
